OSHA Issues Interpretation Letter Regarding Employer Incentive Programs and Post Incident Substance Testing
On October 11th the Occupational Health and Safety Administration (“OSHA”) issued a letter of interpretation clarifying their position on the new recordkeeping rule’s anti-retaliation provisions. Since the rules inception in 2016 there has been much confusion among safety professionals about whether certain employer activities were now prohibited. The letter of interpretation appears to address most concerns employers had about safety incentive programs and post-accident drug testing. OSHA also states that the letter of interpretation supersedes any guidance issued by the agency related to the two issues.

AGC Releases Paper on the Business Case for Diversity & Inclusion in the Construction Industry
The conventional understanding of diversity has evolved over time. What started as a focus on compliance of Equal Employment Opportunity and Affirmative Action requirements has moved into a critical and necessary part of doing business as a way to achieve greater financial success. As the population of the U.S. becomes more diverse, construction companies will need to reflect the changing demographics in order to find workers and remain competitive. The arguments for a company including diversity and inclusion as a key business strategy go beyond the moral imperative of “doing the right thing” and focus on the measurable financial results that can be achieved. AGC’s report, The Business Case for Diversity & Inclusion in the Construction Industry, outlines six reasons why diversity and inclusion are strategically valuable in generating corporate/industry innovation, increasing profitability, and ensuring a positive and sustaining legacy of progress for your firm. Ohio Supreme Court Says Subcontractor’s Defective Work is not a CGL-Covered Occurrence
On October 9, 2018, the Ohio Supreme Court ruled that property damage caused by a subcontractor’s faulty work is not covered under standard commercial general liability (CGL) policies. In Ohio N. Univ. v. Charles Constr. Servs., Inc., Slip Opinion No. 2018-Ohio-4057, the question before the Court was whether a general contractor’s CGL policy covered claims for property damage caused by a subcontractor’s faulty work. The Court stated in its opinion: “Property damage caused by a subcontractor’s faulty work is not an ‘occurrence’ under a CGL policy because it cannot be deemed fortuitous.”

The insurer argued that defective construction was not a covered “occurrence” as interpreted by the Ohio Supreme Court in Westfield Ins. Co. v. Custom Agri Systems, Inc. The Court agreed and found that property damage claims resulting from any defective construction—performed by the general or subcontractor—are not unexpected accidents and, thus, not “occurrences.” Instead, the Court ruled that the defective work of a policy-holding general contractor or its subcontractor is an uninsurable business risk and a normal consequence of doing business in the industry.
