OCA Comments on ODOT DBE Waiver Request
On Friday, December 16, 2016 at ODOT’s Central Office Auditorium, the Ohio Department of Transportation invited the contracting community and general public to discuss their DBE Waiver Request, which had been submitted to the US Department of Transportation on April 15, 2016. ODOT’s waiver requested permission to implement race-conscious goal calculations through either counting participation differently for various ethnic and gender groups or subdividing the DBE goal for a project by race and gender (click here to see a summary of ODOT’s request). OCA opposed ODOT’s waiver request for a variety of reasons in a letter to the USDOT (click here). House Pro Forma Sessions Muddy Overtime Challenge
House lawmakers have already gone home for the year, but a Republican-backed move to kill the Labor Department's overtime rule is in jeopardy because the chamber is technically still in session. The House, on December 8, cast its last votes of the year, appearing to finish up within 60 legislative days from when the overtime rule was published. If that's the case, Congress could restart the clock on a pending overtime challenge in January.
The only problem is that pro forma sessions—such as the eight-minute meeting in the chamber Dec. 12—designed to block President Barack Obama from pushing through recess appointments may also count toward the deadline. Democratic staffers on Congress’ labor committees have been working closely with the House and Senate parliamentarians and have been assured that pro forma days count as legislative days. Trump Taps Fast-Food CEO Puzder as Labor Secretary
President-elect Donald Trump named Andrew Puzder, head of the Hardee's and Carl's Jr. burger chains, as labor secretary on December 8. Puzder, an economic adviser and surrogate to Trump on the campaign trail, is an outspoken critic of Obama administration labor policies. He represents a stark contrast to outgoing Labor Secretary Thomas Perez, who has advanced regulations aimed at tilting the balance in workers’ favor.
“Andy Puzder has created and boosted the careers of thousands of Americans, and his extensive record fighting for workers makes him the ideal candidate to lead the Department of Labor,” Trump said in a statement announcing the move. “Andy will fight to make American workers safer and more prosperous by enforcing fair occupational safety standards and ensuring workers receive the benefits they deserve, and he will save small businesses from the crushing burdens of unnecessary regulations that are stunting job growth and suppressing wages.” Clickhere to read this article in its entirety.
