OCA – Carpenters Agree to Contract Extension
OCA’s Labor Relations Division and the Carpenters union have agreed to a 30-day contract extension of the current highway heavy agreement. The agreement, originally set to expire on March 31, 2018, will now remain in effect until April 30, 2018. All terms and conditions, including wages and benefits will remain the same under the extension. Feedback Needed on Ohio EPA Draft NPDES Construction Storm Water General Permit
The Ohio EPA is asking for feedback on its draft General National Pollutant Discharge Elimination System (NPDES) Permit for Storm Water associated with construction activity. It includes a number of substantive changes to the storm water pollution prevention program requirements and post-construction practices. You can access the public notice, fact sheet, and draft general permit on the Ohio EPA website.

OCA will be submitting comments as part of a coalition of affected groups. Any feedback you could provide regarding proposed permit changes would be helpful in formulating our comments. Please send any comments to

OSHA Looks at Easing Silica Rule Compliance for Contractors
OSHA is aiming to make it easier for construction contractors to comply with the agency’s 2016 rule protecting workers from inhaling silica dust, a mineral that can cause lung disease. The agency is looking at expanding its list of safe construction practices that protect workers from breathing in silica while performing tasks such as polishing stone or cutting concrete. “We are working with the construction community to see if we can add more tasks,” Ann Rosenthal, the department’s associate solicitor for occupational safety and health, said.

The Occupational Safety and Health Administration’s silica rule already details 18 construction methods, together called “Table 1" (29 C.F.R. 1926.1153 (c)(1)), that employers can follow to avoid putting in place a silica dust sampling program. Many of the methods involve vacuuming dust into bags or spraying water to prevent silica dust from blowing away. The construction rule (RIN:1218-AB70), which went into effect Sept. 23, 2017, sets a permissible exposure limit of 50 micrograms per cubic meter.

The 50-microgram limit also applies to general industry and maritime employers with a June 23, 2018, compliance deadline. It also sets an action level at 25 micrograms per cubic meter, which means employers must measure exposure at or above this level. The old rule set a permissible exposure limit of 100 micrograms per cubic meter of air for general industry and between 250 and 500 micrograms per cubic meter for construction and maritime.

Numerous employer groups challenged the rule in federal court. Hopes of overturning the rule were dashed Dec. 22 when the a three-judge panel of the U.S. Court of Appeals For the District of Columbia Circuit unanimously upheld the exposure limit.

OSHA makes reducing trenching deaths a top priority
An alarming leap in excavation and trench-related fatalities has made reducing them an Agency Priority Goal for OSHA for 2018. The agency plans to accomplish this by increasing awareness of trenching hazards in construction, educating employers and workers on safe cave-in prevention solutions, and decreasing the number of trench collapses.

According to the Bureau of Labor Statistics, excavation and trench-related fatalities in 2016 were nearly double the average of the previous five years. OSHA will issue public service announcements, support the National Utility Contractors Association’s 2018 Trench Safety Stand Down, update online resources on trench safety, and work with other industry associations and public utility companies to create an effective public-private effort to save lives. OSHA’s trenching and excavation national emphasis program is also currently under revision.

We encourage Ohio contractors to take advantage of OCA’s excellent competent person training for excavation and trenching safety. There is still time to register for our March 14th class at OCA.
