ODOT’s Bidding, Scheduling and Project Delivery to Continue Unchanged

OCA has received the following statement from the Ohio Department of Transportation:

"In response to the COVID 19 Virus, ODOT, as well as other state agencies, will be transitioning to a teleworking environment. However, the Department remains committed to the timely delivery of the Capital Program. This work is critical to our infrastructure and the citizens of our state. At this time, there are no plans to delay the sale of projects. Prebid questions will be answered as normal. Active projects will remain appropriately staffed with inspection personnel. Clearly this is a fluid situation and as additional information becomes available, we will share it with you." 

In a telephone conference call OCA staff held with the Director and his immediate staff this morning (March 16, 2020), the current status of ODOT’s project delivery will remain unaltered. Approximately 1500 ODOT employees are “teleworking” while the remaining approximately 3500 employees are reporting for work, most notably construction project management staff and inspectors. Issues that may arise on a project-specific basis will be addressed in accordance with current specifications. Director Marchbanks indicated that ODOT’s function to maintain and construct Ohio’s highways is deemed “mission critical” to combatting COVID-19 and supporting economic and societal activity during these trying times. As noted above, should future events warrant, the Department will discuss the situation and articulate any changes in plans as may be necessary.

Recording Workplace Exposures to COVID-19

OSHA recordkeeping requirements at 29 CFR Part 1904 mandate covered employers record certain work-related injuries and illnesses on their OSHA 300 log.

While 29 CFR 1904.5(b)(2)(viii) exempts recording of the common cold and flu, COVID-19 is a recordable illness when a worker is infected on the job.

COVID-19 can be a recordable illness if a worker is infected as a result of performing their work-related duties. However, employers are only responsible for recording cases of COVID-19 if all of the following are met:

1. The case is a confirmed case of COVID-19 (see CDC information on persons under investigation and presumptive positive and laboratory-confirmed cases of COVID-19);
2. The case is work-related, as defined by 29 CFR 1904.5; and
3. The case involves one or more of the general recording criteria set forth in 29 CFR 1904.7 (e.g. medical treatment beyond first-aid, days away from work).

Ohio Industrial Commission Announces Suspension of All Hearings on March 16 and March 17

Agency will begin telephone hearings on March 18

The Ohio Industrial Commission announced today that all workers’ compensation hearings will be suspended Monday, March 16 and Tuesday, March 17, 2020. Beginning Wednesday, March 18, the Commission will begin conducting hearings by telephone for the following issues: permanent total disability, temporary total disability or the termination of temporary total disability, wage loss, allowance and additional allowance. The Ohio Industrial Commission serves injured workers and Ohio employers through expeditious and impartial resolution of issues arising from workers' compensation claims and through the establishment of adjudication policy

Hall of Fame Scholarship Program Applications being Accepted

Since 1996, OCA has awarded nearly $250,000 in scholarships to support promising future talent studying for careers in Civil Engineering, Construction Technology and Construction Management. Scholarships are available for students with graduating goals set at the associate and bachelor's degree levels. OCA recognizes the value that our Hall of Fame Scholarship recipients bring to our industry. These scholarships are for students enrolled in a degree program in Civil Engineering, Construction Technology, Construction Management, or related studies.
