May 1, 2019 Union Wage & Benefit Changes
OCA’s Labor Relations Division recently completed negotiations with the Laborers, Cement Masons and Teamsters Unions for successor heavy highway agreements effective May 1, 2019 through April 30, 2022.  The Operating Engineers Agreement does not terminate until next year, April 30. 2020.  The Carpenter’s agreement, negotiated just last year, is a five-year agreement and does not expire until April 30, 2023.  Following are the wage and benefit changes effective May 1, 2019.  Any fringe benefit not listed will remain unchanged from last year.

Workforce Development Outreach: Creating Awareness in our Communities 
As creating workforce awareness continues to become a larger part of our industry’s recruiting efforts, OCA wants our members to know that your work to engage the next generation is making a difference around the state.

We recently asked the membership to share individual outreach actions they are taking to make young people aware of career opportunities in our industry. After reviewing the many emails submitted, it was clear that collectively we are making a huge reach around the state when it comes to promoting heavy highway careers.
Here is one of the actions shared, with others to be included in future e-newsletters along with being published in the bi-monthly OC magazine.

Company: The Shelly Company 
Event: Mill Valley Elementary Rocks Build Our World Experience, Marysville 
Action taken to create awareness: A team of Shelly employees recently implemented a new classroom presentation strategy, the “Rocks Build Our World” (RBOW) program, to increase the company’s presence in elementary schools located near Shelly operations. The RBOW program aims to introduce young students to the construction industry through short videos, engaging PowerPoint slides and hands-on activities. Employees shared the program in third-grade classrooms at Marysville’s Mill Valley Elementary School to give students a baseline knowledge of construction equipment, products and careers. The following day, the students and their teachers visited nearby Ostrander Quarry to experience first-hand the new information they’d learned. Later, in thank-you notes to Shelly, the students expressed their excitement about the construction careers they’d seen in action. The Shelly Company is passionate about industry education and looks forward to inspiring more young people to consider construction careers as the RBOW program continues to grow.

AGC WebEd Offering For Federal “EEO-1 Survey Reporting Requirements Update”

AGC of America is offering a free WebEd for AGC members—entitled “Critical EEO-1 Survey Reporting Requirements Update”—on May 2, 2:00-3:30 PM ET to update all contractors and subcontractors on the status of the situation and provide a refresher or any new training that might be necessary. To get more information and register for the event, please click here.   OCA strongly encourages you to tune in to this WebEd event if you find your company falls within the reporting requirements listed below.

These reporting requirement are:

  • Private employers (i.e., contractors that do NOT work on government contracts) with 100 or more employees;
  • Federal contractors (i.e., prime contractors and subcontractors that work on federal agency—Corps, NAVFAC, GSA, Dept. of VA, so forth—contracts/subcontracts amounting to $50,000 or more) with 50 or more employees; AND
  • Federally-assisted contractors (i.e., prime contractors and subcontractors that work on state DOT contracts/subcontracts amounting to $50,000 or more) with 50 or more employees.

At this moment, uncertainty over the submission of the pay data portion, or “Component 2”, of the EEO-1 survey continues, pending court guidance.  What we do know is the traditional portion, or “Component 1”, of the EEO-1 survey remains due by May 31, 2019, and per the DC District Court’s ruling, Component 2 is required to be submitted at some point in the near future.

As previously reported, the EEOC has proposed September 30, 2019, as the collection date for this additional data report filing.  However, the court has not yet approved that filing date. Component 2 is a lot of data to collect, aggregate and report (3,660 data fields per employer location); so companies need to begin preparing now and strategizing what it means for their organization.  This WebEd event will provide the guidance you need as the initial reporting date for this information nears.


OCA Member Helps Highlight Work Zone Awareness Week
Last week, during national work zone awareness week, OCA member, Beaver Excavating Company participated in a multi-agency media event designed to take our work zone safety message to the public. 

On April 12, 2019, Randy Martin, Beaver’s Safety Director participated in a press conference on I-75 in Findlay. Martin represented the contracting industry as he discussed the work zone hazards faced by contractors, and conveyed this year’s campaign theme, “Drive Like You Work Here” during his segment. Martin, who also chairs OCA’s Statewide Safety Committee was joined in the media event by Jack Marchbanks, ODOT Director, Chris Hughes, ODOT Deputy Director, District 1, Lt. Matt Crowe, Ohio State Highway Patrol, Findlay division headquarters, Rob White, ODOT Project Engineer, Kirk Slusher, ODOT Assistant Director Field Operations, Captain John Altman, Findlay district commander, Ohio State Highway Patrol and Staff Lt. Jerrod Savidge, assistant Findlay district commander, Ohio State Highway Patrol.

INSPECTION NOTICE

 3M™ DBI-SALA® ExoFit NEX™ Harnesses 

"3M Fall Protection has learned of the possibility of a manufacturing defect in a dorsal d-ring utilized in ExoFit NEX™ harnesses manufactured between January 2016 and December 2018. Although there have been no reported incidents involving this condition, a dorsal d-ring with this defect will not support the load in a fall arrest event which could result in serious injury or death. Harnesses manufactured only within this date range require immediate inspection for lot number 09P1 stamped into a dorsal d-ring. We believe that only one harness was manufactured with a defective D-ring, but we urge inspection of all potentially affected harnesses out of an abundance of caution in the interests of worker safety. 

To address the situation, 3M Fall Protection is launching a global Inspection Notice. As set out in the attached Notice, all ExoFit NEX™ harnesses manufactured between January 2016 and December 2018 require inspection prior to use."
