AGC Encourages Construction Employers to Continue Operating Safely

OCA members are reminded to conform to guidance and Orders that apply to the workforce in general and specifically to project sites at this time. Because highway construction is an industry specifically exempt from the Governor DeWine’s Stay-At-Home Order, we find ourselves under greater scrutiny for the application of COVID-19 avoidance and workforce attendance practices. There is no doubt that these requirements present challenges for maintaining the health of your workers and the operation and efficiency of performing the work. However, as I am sure you are sensitive to, the health of the workforce is paramount and these efforts must implemented to aid in blocking the spread of the coronavirus. We have been reminded by the Ohio Department of Health that local health officials do have the authority to stop projects if they find less than satisfactory precautions are in place. Please review the “COVID-19 RECOMMENDED PRACTICES FOR CONSTRUCTION JOBSITES” on the OCA website which provides necessary guidance. In addition, please see the recent communication, which follows, provided by AGC of America related to this issue.

AGC Encourages Construction Employers to Continue Operating Safely AGC CEO Stephen Sandherr sent a message to every member firm on March 26 urging them to make sure their entire teams are following the guidance set by public health and safety officials to protect their workers from the spread of the coronavirus. Noting that the public was counting on the industry to do its part to block the spread of the coronavirus, he noted that there was no margin for error. Click here to read the entire letter.

UPDATE ON REQUIREMENTS OF FAMILIES FIRST CORONAVIRUS RESPONSE ACT

Employer guidance for the various and newly enacted legislation related to COVID-19 is developing rapidly. DOL has just issued more information about the Families First Coronavirus Response Act, which becomes effective on April 1. This new guidance better defines employer obligations, employee rights, and applicable procedures for application of sick and family leave taken under the Act. This presentation by Bob Dunlevey and Nadia A. Lampton of Taft/Law is an update to their recent presentation exclusively for OCA members, which was highly informative.
