Summary of Paid Leave Mandates under the Families First Coronavirus Response Act, H.R. 6201*

On March 18, 2020, Congress approved and the president signed into law legislation that includes mandates for employer-fronted federal paid leave—emergency sick leave and emergency paid family and medical leave described below. These requirements take effect on April 2, 2020, and sunset on December 31, 2020. However, the legislative environment remains fluid. The Senate could consider altering these paid leave mandates in a COVID-19 economic investment bill, a third COVID-19 relief bill. Such a measure could pass within days and would then need to be considered by the House before it became law. As such, please note that the information in this document is potentially subject to change before it takes effect.

From the onset, AGC of America opposed this regime of construction contractor-fronted paid leave mandates, as our members’ cash-flows tighten, markets contract and uncertainty continues. Instead, AGC called upon Congress to enable federally-backed agencies (such as the Social Security Administration) and/or programs (such as Unemployment Insurance (UI)) to provide such paid leave compensation. This approach would provide financial security and economic resiliency for both employers and employees to endure this crisis.

COVID-19 Recommended Practices for Construction Jobsites

Personal Responsibilities

• It is critical that individuals NOT report to work while they are experiencing illness symptoms such as fever, cough, shortness of breath, sore throat, runny/stuffy nose, body aches, chills, or fatigue.

• Individuals should seek medical attention if they develop these symptoms.

Social Distancing

• Do not host large group meetings. CDC recommends that we avoid gatherings of 10+ people; and when meeting, that we keep a 6-foot distance between people. Perform meetings online or via conference call whenever possible.

• To limit the number of people on a jobsite, allow non-essential personnel to work from home when possible.

• Discourage hand-shaking and other contact greetings.

Ohio Bureau of Motor Vehicles (BMV) Closings and FAQ's

As Governor DeWine recently announced, effective March 19, the Ohio Bureau of Motor Vehicles (BMV) is closing 181 BMV deputy registrar locations throughout Ohio. Five locations will remain open to provide the following services ONLY:

•   Issuance of commercial driver licenses, or CDLs
•   Renewal of CDLs

All other services will be discontinued.

Also, 52 driver examination stations will close until further notice. Five locations will remain open to perform commercial knowledge exams only.

Law enforcement is also being advised to use discretion and adjust enforcement and give consideration to drivers whose licenses recently expired and may be unable to renew due to agency closure or self-quarantine situations.

The BMV is pausing suspensions for failure to pay or renew a license. Customers are encouraged to renew vehicle registrations online at bmv.ohio.gov or by mail.

Below are the five Deputy Registrar and Driver Examination stations open for CDL services only, which include CDL renewal, TIPIC, HAZMAT endorsement, and knowledge testing:

Update on Ohio811 Sevices for Utility Locates

It has come to our attention that there is misinformation circulating within our industry regarding the status of OHIO811 and our ability to receive and send excavation locate requests. Please be aware that OHIO811 is 100% fully operational and continues to meet our obligations under the Ohio Revised Code as well our commitment to our members, the industry and citizens of Ohio. OHIO811 has no plans, nor any authority, to cease or restrict any method of receiving locate requests from excavators or providing those notices to our member utilities. We will however, continue to implement practices that are consistent with Governor DeWine’s Executive Orders and the recommendations of state and national health officials to help keep our staff safe and slow the spread of COVID-19.
