• having an advocate in areas like public agency (including ODOT) communications, labor relations and legislative issues is critical,

• having a partner to wade through the endless complex updates and changes our industry is experiencing daily, pull out the details that matter most and communicate that information in a timely, concise and easily accessible manner is invaluable, and

• staying engaged and connected with the heavy/highway community is more important than ever.

OCA is proud to be your advocate and partner. Everything we do is for the benefit of our members, and we continue to depend upon your input to know that we are providing what you need – when you need it.

OCA’s Group Rating Program for Ohio Workers Comp

Each year Ohio employers can participate in BWC’s Group-Experience-Rating Program or Group-Retrospective-Rating Program. While these programs are not required, they do provide you with an opportunity to significantly reduce your workers’ compensation premiums, while increasing your awareness of safety and risk-management strategies.

Workplace safety is an important component of these programs. To succeed in accident prevention, we encourage you to use the many resources available to you. We believe a group-rating program is a partnership that includes you and your employees, your sponsoring organization (OCA) or third-party administrator (CompManagement) and BWC. Each has specific roles and responsibilities, all designed to assist in preventing workplace accidents.

Each year, OCA publishes and distributes a group rating safety accountability letter. This letter outlines the safety services expectations you should have as an employer enrolled in a group-rating program. We encourage our members to review the letter here. It is also posted on our website at www.ohiocontractors.org in the Safety Resources Section.

If you have any questions about OCA’s Group Rating Program for Workers Comp, please contact Mark Potnick in the OCA office.

DOL Releases Streamlined FMLA Forms
Publishes RFI Seeking Additional Public Input

The United States Department of Labor’s Wage and Hour Division (WHD) recently announced significant steps to streamline optional-use forms that workers can use to request and employers can use to coordinate leave under the Family and Medical Leave Act (FMLA). WHD also published a Request for Information (RFI) in the Federal Register seeking the public’s feedback on the law’s administration and use.

WHD’s new forms are intended to be simpler and easier for employees, employers, leave administrators and healthcare providers to understand and use. Revised with substantial public input, the forms include more questions that users can answer by checking a response box and electronic signature features to reduce contact. WHD believes the changes will reduce the time users spend providing information, improve communications between leave applicants and administrators and reduce the likelihood of violations.

The Department routinely reviews its policies to ensure its regulations reflect changes in the workplace and published the RFI to obtain feedback on challenges or best practices in the use and administration of the FMLA. Information collected will help the Department identify areas for additional compliance assistance to ensure the FMLA is understood by employers and employees alike.

For more information about the FMLA and other laws enforced by the Wage and Hour Division, contact the Division’s toll-free helpline at 866-4US-WAGE (487-9243). Information is also available at www.dol.gov/agencies/whd.
